By downloading or using SleepBestie, these terms will automatically apply to you. Please read them carefully before using the app. These Terms of Use govern your access to and use of our sleep monitoring and wellness application and related services. By accessing and/or using SleepBestie, you accept and agree to be bound by these terms and our Privacy Policy. If you do not agree to these terms, you must not use the app.
NOTE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION WITH A CLASS ACTION WAIVER. PLEASE REVIEW SECTION 15 BELOW BEFORE ACCESSING OR USING OUR SERVICES.
1. Platform Services
Our Services include the following: (i) integrating user inputs from Apple HealthKit accounts to access your health data; (ii) utilizing this data to generate sleep quality metrics and health insights; and (iii) providing AI-powered analysis through third-party AI services to enhance your sleep understanding.
You acknowledge and consent to our discretion in modifying, updating, or otherwise altering these Services. Please be aware that the availability and functionality of Third-Party Sources are governed by their respective terms of use.
2. Application License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use SleepBestie on your personal devices for your individual use.
You are not allowed to:
- Copy, modify, or create derivative works of the app
- Reverse engineer, decompile, or attempt to extract the source code
- Remove, alter, or obscure any proprietary notices
- Use the app for any commercial purposes without our written consent
- Distribute, rent, lease, or sublicense the app to third parties
- Use the app on devices you do not own or control
- Permit others to use your account or access the app
The app and all intellectual property rights remain the exclusive property of our company.
3. HealthKit Data Usage
SleepBestie integrates with Apple HealthKit to access your health data, including but not limited to:
- Sleep data (sleep stages, duration, bedtime, wake time, sleep efficiency)
- Heart rate information during sleep and exercise
- Basic demographic information (age, biological sex, height, weight)
- Activity data (steps, exercise minutes, calories, active energy)
- Respiratory rate and oxygen saturation data
- Additional health metrics that may be added in future updates
You maintain full control over your HealthKit data authorization. You can revoke access at any time through iOS Settings > Privacy & Security > Health > SleepBestie.
When you use AI analysis features, we may transmit your health data to third-party AI services for analysis. This transmission is encrypted and secure, and data is not retained by AI services after analysis.
We do not sell, rent, or share your health data with third parties for marketing purposes.
4. User Input and Settings
You may provide certain information and preferences within the app, including:
- Sleep goals and target bedtime settings
- Health objectives and personal preferences
- App configuration and notification settings
You are responsible for the accuracy of any information you provide. We rely on this information to deliver personalized recommendations and insights. You can modify or delete your input data at any time through the app settings.
5. Health Information Disclaimer
IMPORTANT: SleepBestie is designed for wellness and fitness purposes only and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
- The information provided by the app is for general informational purposes only
- Sleep quality scores and health insights are estimates based on available data
- The app should not be used as a substitute for professional medical advice
- Always consult with qualified healthcare professionals for medical concerns
- Do not ignore, delay, or discontinue medical treatment based on app information
- The app may not detect all health conditions or sleep disorders
- Sleep recommendations may not be suitable for everyone
IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD DIAL "911" OR YOUR RELEVANT EMERGENCY NUMBER IMMEDIATELY.
We make no warranties about the accuracy, completeness, or reliability of health information provided by the app.
6. AI Features and Third-Party Services
SleepBestie includes AI-powered analysis features that utilize third-party AI services (such as DeepSeek) to provide personalized sleep insights.
- AI analysis is performed through secure, encrypted connections to third-party AI services
- Your sleep data is transmitted as prompts to AI services for analysis
- All AI interactions are temporary and data is automatically cleared when you exit the app
- No AI interaction data is stored persistently on your device or our servers
- AI services do not retain your data after processing
- AI analysis is integrated into the app's core functionality
- We rely on third-party AI services for their safety measures and content filtering
The third-party AI services we use implement their own comprehensive safety measures and content moderation systems.
7. Third-Party AI Services
SleepBestie utilizes third-party AI services to provide enhanced analysis capabilities.
- We use reputable AI service providers that implement their own safety measures
- These services are responsible for their own content filtering and moderation
- Third-party services conduct their own testing and evaluation of AI models
- We do not control or manage the AI models or their safety measures
- Your data is transmitted securely to these services for processing only
- We rely on these services' compliance with industry standards and regulations
While we carefully select our AI service providers, we cannot guarantee their performance or safety measures.
8. Data Retention and Privacy
SleepBestie operates as a privacy-first application with minimal data retention.
- Your health data is stored locally on your device through Apple HealthKit
- We do not maintain user accounts or store personal information on our servers
- AI interaction data is automatically cleared when you exit the app
- No conversation history or AI analysis data is retained
- You can manually clear all app data through device settings
- Local analysis features are available without any data transmission
Your privacy is protected through local storage and automatic data clearing mechanisms.
9. Service Availability
We strive to maintain app functionality and availability, but cannot guarantee uninterrupted service.
- Certain features require an active internet connection
- We may temporarily suspend service for maintenance or updates
- We reserve the right to modify, suspend, or discontinue features at any time
- App functionality may be limited if HealthKit access is revoked
- We are not responsible for device-specific compatibility issues
- Service availability may vary by region
We will make reasonable efforts to notify users of significant service changes or interruptions when possible.
10. User Responsibilities
As a user of SleepBestie, you agree to:
- Keep your device secure and protect your HealthKit data
- Use the app in compliance with applicable laws and regulations
- Not attempt to circumvent app security measures or restrictions
- Not use the app for any illegal or unauthorized purposes
- Maintain the confidentiality of your personal health information
- Report any app malfunctions or security concerns promptly
- Not share your account credentials with others
- Not use the app to harass, abuse, or harm others
We recommend against jailbreaking or rooting your device, as this may compromise app security and functionality.
You are responsible for all activities that occur under your account.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We provide the app "as is" without warranties of any kind
- We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid for the app in the 6 months immediately preceding any claim giving rise to such liability
- We are not responsible for data loss, device damage, or health consequences
- We are not liable for damages resulting from viruses, data corruption, or transmission errors
- We are not responsible for third-party content or services
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
12. App Updates and Changes
We may release updates to improve SleepBestie's functionality, security, and user experience.
- Updates may include new features, bug fixes, or performance improvements
- Some updates may require iOS system updates to maintain compatibility
- We may discontinue support for older iOS versions
- You are responsible for downloading and installing updates
- We reserve the right to modify or remove features in updates
- Beta features may be less reliable and subject to change
Continued use of the app after updates constitutes acceptance of any changes to these terms.
13. Subscriptions and Payments
SleepBestie may offer premium features through subscription services.
- Subscriptions automatically renew at the full price unless cancelled
- You can cancel subscriptions through your device's app store settings
- We may change subscription prices with 30 days notice
- Refunds are subject to app store policies
- We are not responsible for billing issues with app stores
- Subscription features may change over time
If you are a California resident, you have the right to cancel automatic renewals as provided by California law.
14. Termination
These Terms remain in effect until terminated by either party.
You may terminate by:
- Deleting the app from your device
- Revoking HealthKit data access permissions
We may terminate or suspend your access if:
- You violate these Terms of Use
- We discontinue the app or service
- Required by law or regulatory action
Upon termination, you must cease using the app and may delete it from your device. Provisions regarding liability limitations and intellectual property shall survive termination.
15. Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY, AS IT LIMITS THE MANNER IN WHICH YOU MAY SEEK RELIEF.
If you have a dispute with us, we encourage you to first contact our support team to attempt to resolve the matter informally.
Except for disputes seeking injunctive relief for intellectual property violations, any dispute arising from these Terms or your use of SleepBestie shall be resolved through binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC).
- The seat of arbitration shall be Hong Kong
- Arbitration proceedings shall be conducted in English by a single arbitrator
- The law of the arbitration clause shall be the laws of Hong Kong
- Both parties waive the right to bring or participate in class actions
This arbitration agreement is entered into voluntarily by both parties.
16. Legal Terms
Governing Law: These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding SleepBestie.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations to any third party.
Notices: We may provide notices through the app, email, or other means. Notices are effective upon receipt or 24 hours after sending.
17. User Control and Safety Measures
You have control over your data and privacy in SleepBestie.
- AI interaction data is automatically cleared when you exit the app
- All AI interactions are processed securely and temporarily
- No persistent storage of AI conversation history
- You can revoke HealthKit permissions at any time
- We implement secure data transmission protocols
- We carefully select and monitor our AI service providers
We take reasonable measures to ensure secure data transmission and work with reputable AI service providers.
